Small claims court

If you owe money to a person or company and have been unable to pay, they may take legal action and use the small claims procedure to recover the money from you.

The small claims court refers to small claims (debts of up to £10,000) that go through the court system. You could be taken to court using the small claims procedure by an individual or a company that you owe money to, or by a landlord, for instance if you owe them money for rent or repairs.

Often, the first time you will be aware that they are taking action is when you receive a claim form stamped by the court. This could be delivered in the post or be given to you in person. It’s important not to ignore the form; if you do, decisions could be made in court without you having the opportunity to put your case forward.
